These terms and conditions apply to the use of this website and the purchase of personalised products through the site. By using this website and/or placing an order you agree to be bound by these terms and conditions.  If you do not agree to these terms and conditions please do not use this website.  These terms and conditions do not affect your statutory rights as a consumer.

Formation of a contract

All requests by you to order personalised products through this website shall be provisional and non binding unless or until a confirmation of order email has been sent to you at the email address you supply at the time of order.  A contract between you and Jane Hamerton Limited shall not be established until this takes place.

Ordering

Products can be ordered directly through this website and payment can be made by credit or debit card using our secure payment service provider PayPal.  You can also place your order over the phone or via email.  Our contact details are set out below.  Where payment is made by cheque, we will not process your order until the cheque has cleared.

Delivery

Your order will be delivered to the address given at the time of your order.  UK delivery times are normally between 7 to 10 days.  During busy times (i.e. Christmas) there might be a slight delay in which case we will notify you accordingly. Standard delivery is via Royal Mail/Parcelforce.

If there is large order we use a courier company Fedex. The goods will need to be signed for.

Delivery charges for destinations outside of the UK are as follows: Europe: £10, the rest of the world: £40. Products ordered for delivery outside the UK may also be subject to import duties and taxes, for which you will be responsible; please contact the relevant customs office for further information.

Product Details and Availability

Please note that photographs are for representational purposes only.  Although we have made every effort to display as accurately as possible the colours of the products that appear on this website, the actual colours you see will depend on your monitor.  Therefore, we are unable to guarantee that your monitor’s display of any colour will accurately reflect the colour of the products delivered.  Also, please note that as these are personalised hand made products, they can vary slightly in design and look.

All products are offered subject to availability at the time of ordering.  Should any item be out of stock there may be a delay in delivery and you will be notified accordingly and given the opportunity to cancel your order.

Cancellation and Returns

PLEASE CHECK CAREFULLY WHEN ENTERING THE DETAILS OF HOW YOU WOULD LIKE YOUR PRODUCTS PERSONALISED.  ONCE SEWN, WE CANNOT UNPICK.

Please notify us within 48 hours of placing your order if you would like to cancel your order.  After this time, we may have started to sew your products and as all our products are personalised to your specifications, we are unable to accept returns unless the products are faulty or are different from those you ordered.  If the products are faulty or different from those you ordered, please return them to us within 7 days and we will be happy to send you a replacement or, if you prefer, a full refund together with a refund of your postage.  When returning products we recommend that you obtain a free receipt of postage from the Post Office as proof of posting as we are unable to accept responsibility for parcels lost in transit.  Our return address is set out below.

Limitation of Liability

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order secure, but in the absence of our negligence we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from this website.

Although this website and any emails and attachments sent from Jane Hamerton Limited are believed to be free from computer viruses, we strongly advise you to carry out your own virus check before downloading material and/or opening any attachments.  In the absence of our negligence, we cannot be held liable for any loss you may suffer if a virus or other harmful device infects your computer.

We will have no liability to you for any failure to deliver the products you have ordered, or any delay in doing so, or for any damage to products delivered, that is caused by any event or circumstances beyond our reasonable control including, without limitation, all postal strikes and other industrial disputes, any breakdown of systems, failures of sub-contractor transport or network access, flood, fire, explosion or accident.

To the fullest extent permitted by law, the limitation of our liability to you in connection with this website, whether in contract, tort (including, without limitation, negligence), pre-contract or other representations or otherwise, shall be limited to the price you have paid to us.

All copyright, trade mark and other intellectual property rights in the material and content supplied as part of this website is owned by or licensed to Jane Hamerton Limited and you may use it only as authorised by us.  You acknowledge and agree that the material and content contained within this website is made available for your personal non-commercial use only.   You may, if necessary to make a purchase, download such material and content onto your computer hard drive for such purpose and to show others.  Any other use of the material and content of this website is strictly prohibited unless our permission is given.

Security and Privacy

Your security and privacy is very important to us.  The personal information you give us is treated as highly confidential and is held securely and used only in accordance with the Data Protection Act 1998.  Please see our Privacy and Security Statement.

Governing Law

Contracts for the purchase of products through this website will be governed by English law and any dispute arising from or relating to such contracts shall be subject to the non-exclusive jurisdiction of the English courts.
